Hola.

Necesito hacer una consulta. Desde hace unos días Orange, la compañía de telecomunicaciones me insta a borrar un canal de Youtube por inflingir, según ellos la propiedad intelectual de su marca. El canal se llama "OrangePiWeb JaviPSantos" y se llama igual que mi página web oficial: "https://orangepiweb.es" igual que como se llamaba antes el canal.

y trata sobre los miniordenadores "Orange Pi", familiares de los "Raspberry Pi" y "Banana Pi", todos ellos como podéis ver son nombres de frutas. El caso es que me quieren obligar a cambiar el nombre del canal y me gustaría saber si tienen derecho a hacerlo. De momento, y por miedo al abuso de poder de una gran empresa como esta se lo he cambiado a NaranjaPiWeb, pero la pregunta es ¿tienen derecho a hacerlo? ¿Pueden prohibir usar una palabra tan común como Orange?

Orange trade mark registrations cover a wide range of goods and services including in the fields of telecommunications, IT, TV and cinema, business services, entertainment, financial services, healthcare, advertising, educational and cultural activities, consumer electronics, charitable services, and innovation services. 

The trademarks, logos and slogans of the Orange Group are exclusively used by Orange Group and its licensees and any unauthorized use by a third party may constitute trademark infringement.

Hence, we ask that you immediately discontinue any and all use of the Channel Name  and undertake that you will not in future use or register any channel names which include the word “orange”.

Please note that should you and your company refuse or fail to comply with these requirements within 14 days of the date of this letter Orange will take such further action to protect its rights as it deems necessary.  Orange’s remedies in this matter could include an injunction against you as well as damages and legal costs.
