Copyright infrignment or moral issue?

Hi everyone, I have been invited to become a partner of YouTube; I have only uploaded a couple of videos and just one that can be called "popular", althoght it isn´t Gangnam Style (no, I´m not Psy).

The thing is, that this video that I uploaded was downloaded like 7 years ago using a p2p program, I do not know if it was iMesh, Kazaa, Ares or which one; but I do not have the original anymore. In the description of the video I describe this situation but now I´m getting frightned by all copyright laws and ToS as monetization was accepted.

The question is: Can I call this video of my own as I found it and in 7 years online I have never received any kind of copyright claim or such about it? If the owner appears, and he can prove it is of his own, I would honestly accept to shut it down.

I hope the question is clear, as I valorate my YouTube account and wouldn´t like to get into a copyright issue for monetizing a video I found and no one claims for it.
